Terms and Conditions

Definitions

  • ABA means the Australian Business Account.
  • Account means your registered account within the ABA service.
  • You and your means the user of the ABA.
  • Our, us and we means the Commonwealth of Australia represented by the Department of Industry, Innovation and Science.
  • Loss means loss, damage, cost or expense (to any person or property) including consequential or indirect loss or any loss of profits, data or revenue.

The ABA service

  • These terms and conditions apply for the ABA service.
  • You may choose not to use the ABA service if you wish.
  • To create and use the ABA you must accept and comply with these terms and conditions.
  • We may make changes to the ABA terms and conditions services at any time. If this happens, you will be asked to accept the new terms and conditions.
  • You may close your account online at account.business.gov.au.
  • If your account is not available for any reason, you can communicate directly with your relevant state Agency, for example by telephone, in person or through their website.
  • Having an account does not:
    1. affect or reduce any obligation owed to you by any Agency; or
    2. reduce any obligation you owe to any Agency.

Your Responsibilities

  • You must:
    1. keep your account username, password and your secret question and answer secure at all times;
    2. not permit any other person to use your username and password; and
    3. change your password regularly.
  • You should use appropriate and up-to-date firewall and anti-virus software to protect your computer systems.

Our Responsibilities

  • If the ABA terms and conditions change, we will ask you to accept the new terms and conditions. If you choose not to accept the terms and conditions, we will close your account.
  • We have responsibilities relating to the security and privacy of your account information and transactions.
  • We will use all reasonable endeavours to ensure that your information is not corrupted or changed. We have implemented a number of mechanisms to achieve this.
  • We will take reasonable care in providing the information and services through the ABA website. However, we cannot accept liability for all possible losses that could arise as a result of your use of the ABA. If a problem or loss is caused by the information you included your account or if your computer was compromised in some way, we cannot take responsibility for causing the problem. We will, however, do our best to help you if we can.

Privacy

  • We may collect your personal information or the personal information of an employee of your business nominated by you including name, contact phone number and email address to provide you with the ABA services. You are not obliged to provide the information.
  • We will only use and disclose personal information contained in the ABA to a person, body or other agency:
    1. as permitted by these ABA terms and conditions;
    2. to provide you with a Department of Industry, Innovation and Science service or programme that you have requested;
    3. as authorised by law, for example, if a law enforcement authority or court order lawfully directs us to disclose the information of a user of the ABA;
    4. to permit another government agency to provide you with a service or programme that you have requested;
    5. to the ABA Smartform Centre third party provider Avoka for the sole purpose of incident diagnosis.
  • The Department of Industry, Innovation and Science will only use personal information contained in the ABA or ABA Smartforms to provide you with a Department of Industry, Innovation and Science service or programme. If you are providing information to access a non-Department of Industry, Innovation and Science programme, for example a programme provided by another government agency, that information will not be accessed by Department of Industry, Innovation and Science employees. The only exception to this is where Senior Analysts within the Department of Industry, Innovation and Science require access to your information for the sole purpose of troubleshooting technical errors. Where this occurs Senior Analysts will only access the data with permission and at the request of our client agencies.

Please note that if you are providing information to the Department of Industry, Innovation and Science for the purpose of permitting another agency to provide you with a non-Department of Industry, Innovation and Science service or programme you should also refer to the relevant agency’s privacy policy.

  • These ABA terms and conditions do not negate any terms or conditions of use of any other government Agency website.
